Terms of Service

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity, and Aillegent Private Limited, doing business as Eventik, concerning your access to and use of the https://eventik.ai website, our mobile applications, and related services (collectively, the "Service").

We are registered in India with our office at 602 Synergy Space, D-Mart Road, Kudasan, 382421, Gujarat.

By accessing the Service, you confirm that you have read, understood, and agree to be bound by all of these Terms. If you do not agree, you are expressly prohibited from using the Service and must discontinue use immediately.

Electronic communications: By creating an account or using the Service, you consent to receive communications from us electronically — such as account, transactional, and service-related emails and in-app notices — and you agree that these electronic communications satisfy any legal requirement that such communications be in writing.

Eventik Ownership

Unless otherwise indicated, the Service — including all source code, databases, functionality, software, website designs, audio, video, text, and graphics (the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") — is owned or controlled by us or licensed to us, and is protected by copyright, trademark, and intellectual property laws.

User Content (Photographer/Studio)

Studio Admins retain full ownership of all photographs, metadata, and event details they upload. By uploading content, you grant Eventik a limited, non-exclusive, worldwide, royalty-free license to host, store, compress, copy, and run face-matching algorithms on the images solely to deliver the matching gallery service to your clients. This license terminates automatically when a photo or event is deleted.

Attendee Matched Photos

When you join an event as an attendee, the photographs you are matched with are licensed to you for personal, non-commercial viewing and downloading only. You may not sell, resell, lease, syndicate, or use these images to train third-party artificial-intelligence or face-recognition models.

You may be required to register an account to access specific features. By registering, you agree to:

• Provide true, accurate, current, and complete registration information.
• Maintain the security and confidentiality of your password and accept all risks of unauthorized access to your account.
• Notify us immediately at info@eventik.ai if you suspect any security breach or unauthorized use of your credentials.
• Avoid creating multiple accounts to abuse free-tier limits, impersonating other individuals, or selecting offensive usernames.

Eventik offers subscription plans (e.g., Ignite, Momentum) billed monthly or yearly in Indian Rupees (INR).

• Razorpay integration:All credit/debit card, UPI, net banking, and wallet transactions are securely processed by our payment partner, Razorpay. By initiating a purchase, you agree to Razorpay's Terms of Service and Privacy Policy.
• Auto-renewal: Paid subscriptions automatically renew at the end of each billing cycle unless cancelled. You may cancel at any time from the Billing section of your dashboard.
• GST: Prices are listed in INR and are subject to 18% GST at checkout. Razorpay issues a GST-compliant tax invoice containing your company name and GSTIN, if provided.
• Free plans:We may offer a free tier with limited features, events, and storage. Free plans are provided "as is," may be changed or discontinued at any time, and are subject to the same acceptable-use rules as paid plans.

We want you to be satisfied with Eventik. Our refund terms are as follows:

• General rule: Subscription payments are generally non-refundable for partial billing periods.
• Refund processing: Valid refund requests are submitted immediately. Depending on your financial institution, it can take 7 to 10 working days for a refund to reflect in your account or card.

You may not access or use the Service for any purpose other than that for which we make it available. Prohibited activities include:

• Systematically scraping, downloading, or harvesting photographs, data, or content to compile databases or directories without written permission.
• Attempting to reverse-engineer, decompile, or bypass technical limits, security features, or API rate limits.
• Using face recognition, matching, or selfies to track, stalk, or surveil individuals without their explicit consent.
• Uploading viruses, malware, or obscene, abusive, or unlawful photographs (including images taken in private spaces without consent).

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Eventik makes no warranties or representations about the accuracy, reliability, or completeness of the Service or the face-matching results, and does not warrant that the Service will be uninterrupted or error-free.

Face-matching limitation: Face recognition results depend heavily on lighting, camera angles, resolution, and photo quality. Eventik does not warrant that every photo in which a Guest User appears will be identified, or that the matching process will be error-free.

You are responsible for the content you upload and for ensuring you have the necessary rights and consents (including the consent of identifiable individuals where required by law) to upload and process it through the Service.

While we take reasonable measures to protect and back up data, the Service is not a substitute for maintaining your own copies of important files. To the maximum extent permitted by law, Eventik is not liable for any loss, deletion, or corruption of content or data — including photographs and event media — however caused. Deleted events and account data are removed in accordance with our Privacy Policy and the in-app retention windows.

To the maximum extent permitted by law, Aillegent Private Limited, its directors, employees, or agents will not be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages (including lost profits, lost revenue, or loss of data) arising from your use of the Service.

Notwithstanding anything to the contrary herein, our total liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the lesser of the amount paid by you to us during the twelve (12) month period prior to the cause of action arising, or INR 1,000.

These Terms and your use of the Service are governed by and construed in accordance with the laws of India.

Any dispute arising out of or in connection with these Terms — including any question regarding their existence, validity, or termination — shall be subject to the exclusive jurisdiction of the courts located at Gandhinagar, Gujarat, India.

These Terms remain in full force and effect while you use the Service. You may terminate your account at any time from your Profile settings.

We reserve the right, in our sole discretion and without notice or liability, to deny access to and use of the Service (including blocking specific IP addresses) to any person for any reason, including breach of any representation, warranty, or covenant contained in these Terms.

We reserve the right to modify or replace these Terms at any time at our sole discretion. When we make changes, we will update the "Last updated" date above, and material changes will, where appropriate, be communicated through the Service or by email.

It is your responsibility to review these Terms periodically. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
